Правовые рамки принятия политических решений (на примере законодательства о борьбе с терроризмом в РФ и ФРГ)

В статье рассматривается вопрос о соотношении права и политики, анализируются правовые рамки принятия политических решений в современных демократических государствах. Краткий исторический обзор позволяет лучше понять современные подходы к анализу террора и терроризма. Автор обращает внимание на экономическую составляющую современного терроризма. На примере законодательства о терроризме в ФРГ и РФ ставится вопрос об этических компонентах политики и права.

Framework of Making Political Decisions (Case Study of Legislation for Fight against Terrorism in RF and FRG)

The problem of terrorism itself has a long history. However, the nature of terrorism and its manifestations are changing, and new opportunities, particularly associated with globalization process, constantly arise. This makes it relevant to study the relation of political and legal matter, in the issue of counter-terrorism decision-making.

My article deals with the question of the relationship between law and politics by analyzing legislative framework during the acceptance of political decisions in modern democratic states. For this goal I use general-logical, political and legal, and comparative analysis (which I apply towards comparison of counter-terrorism legal systems in Russian Federation and Federal Republic of Germany).

The short historical review allows understanding the modern approach to the analysis of terror and terrorism. With regard to modern terrorism, I show that organizations based on religious foundations, are more willing to go to the most mass form of terror, because they regard themselves as the embodiment of the common good, while the other is the embodiment of evil. For the salvation of souls, it is possible, in their view, to use any means. As for terrorism, which is used by groups with clear political motivation, they do not resort to weapons of mass destruction. At the same time, I especially note the economical part of modern terrorism. Case of fight against terrorism in FRG and RF allows me to show ethical components of politics and law.

I conclude law and politics permeate each other, limit each other, and in a democratic state are interdependent. Some social phenomena may cause the legislator desire significantly narrow down legal field. The goal of law is to resist such aspirations and to defend human and civil rights that is fundamentally in deciding in countering terrorism.
